1. Acceptance of Terms

By downloading, accessing, or using the Liddsecure application, website, connected devices, or any related services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Services.

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification.

2. Eligibility

You must be at least 18 years old to create an account and use the Services independently. Users under 18 may only use the Services through a managed account created by a parent or legal guardian who accepts these Terms on their behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your password secure and not share it with others.
• Notify us immediately of any unauthorised access to or use of your account.
• Not create accounts for the purpose of impersonating another person.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Use of Services

Liddsecure provides family safety and location-sharing services including, but not limited to, live location tracking, smart alerts, safe-zone monitoring, crash detection, and emergency SOS features. You agree to use these Services only for lawful purposes and in accordance with these Terms.

You agree NOT to:

• Use the Services to stalk, harass, threaten, or otherwise violate the rights of any person.
• Track or monitor any individual without their knowledge and explicit consent.
• Use the Services for any illegal or unauthorised purpose.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Services.
• Interfere with or disrupt the integrity or performance of the Services.
• Use automated systems (bots, scrapers, etc.) to access the Services without our express permission.
• Misrepresent your identity or affiliation with any person or entity.

5. Location Sharing & Safety Features

Liddsecure's core functionality relies on location data. By using the Services, you acknowledge and agree that:

• Consent-Based Sharing: Location sharing within circles is consent-based. All circle members can see each other's real-time location. You should only join circles with people you trust.
• Safety Overrides: In the event of a detected emergency (e.g., crash detection, SOS activation), the app may transmit your location to emergency services and designated emergency contacts, even if you have paused location sharing with circle members.
• Accuracy Disclaimer: Location data depends on GPS, cellular, and Wi-Fi signals and may not always be accurate. Liddsecure does not guarantee the precision of location data and is not liable for inaccuracies.
• Not a Substitute: The Services are not a substitute for calling emergency services (e.g., 999/911). In an emergency, always contact emergency services directly.

6. Subscriptions & Payments

Some features of Liddsecure require a paid subscription. If you choose to subscribe:

• Subscriptions automatically renew at the end of each billing period unless cancelled beforehand.
• You can manage or cancel your subscription through your app store account settings (Apple App Store or Google Play Store).
• Refunds are handled in accordance with the policies of your app store provider.
• We reserve the right to change pricing with reasonable notice. Price changes will take effect at the start of your next billing cycle.

7. Intellectual Property

All content, features, functionality, branding, trademarks, and intellectual property associated with the Services are owned by Liddsecure or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our express written permission.

8. User Content

You retain ownership of content you submit through the Services (such as profile photos, messages, and feedback). By submitting content, you grant Liddsecure a worldwide, royalty-free, non-exclusive licence to use, store, and display that content solely for the purpose of providing and improving the Services.

You are solely responsible for the content you share and must not upload content that is unlawful, offensive, or infringes on the rights of others.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Liddsecure does not warrant that the Services will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy of location data, crash detection, or any safety feature. The Services are designed to assist — not replace — personal safety judgement and emergency services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIDDSECURE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or £100 (whichever is greater).

11. Indemnification

You agree to indemnify, defend, and hold harmless Liddsecure, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

You may terminate your account at any time by deleting it through the app settings or by contacting us. We may suspend or terminate your access to the Services at any time, with or without cause or notice, if we believe you have violated these Terms.

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@liddsecure.com.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
